Can I get an annulment?

Did you have a wild night and wake up married? Or maybe you only dated for a few months (or weeks) and decided to just jump the broom but now you’re regretting it?

Whatever your reasoning may be, you may be thinking well it’s only been a few weeks (or months) and I’ve made a mistake so I’ll just get an annulment. Sorry to tell you but not so fast!

What exactly is an annulment?

An annulment is a legal dissolution of your marriage. However, if your marriage is annulled, it is treated legally as if it never happened.

Why would I want an annulment rather than a Divorce?

Many people associate a negative stigma with a Divorce. Also, if your marriage is relatively short, most people would prefer to treat it as if it never existed rather than getting a traditional divorce.

In what situations can I get an annulment?

Unfortunately, New Jersey only permits an annulment in limited circumstances. Some states permit an annulment if you’ve only been married for a short period of time. In NJ, that’s not the case. NJ only will permit an annulment in one of the following situations:

  • If you or your spouse were married to someone else at the time of your marriage;

  • the marriage was illegal because you and your spouse are too closely related;

  • incurable impotence by you or your spouse at the time of the marriage;

  • due to a mental condition or intoxication, you or your spouse was unable to comprehend that you were marrying;

  • You or your spouse was under the age of 18 years at the time of the marriage, unless such marriage be confirmed by her or him after arriving at such age;

  • fraud, or lies, by you or your spouse that induced the other to marry;

  • you or your spouse only married because of severe threats
